AccuClaim Terms of Service
Effective Date: January 1, 2026
These Terms & Conditions govern your use of the AccuClaim platform, including the AccuClaim website, mobile application, and related services (collectively, the “App”). By accessing or using the App, you agree to these Terms.
“User” means any individual or business entity authorized to access or use the App.
1. Eligibility & Use
AccuClaim is intended exclusively for restoration professionals and businesses operating within the United States. Use of the App is permitted only for lawful business purposes.
2. Accounts & Access
Accounts are created and configured by AccuClaim administrators.
Users are responsible for maintaining the confidentiality of login credentials and all activity under their account.
Account deactivation occurs upon request or for violation of these Terms.
3. User Responsibilities
You agree to:
Provide accurate and lawful information
Use the App in compliance with all applicable laws
Ensure uploaded content does not violate third-party rights
Maintain appropriate insurance and regulatory compliance
4. Prohibited Conduct
You may not:
Reverse engineer or attempt to access source code
Upload malicious, unlawful, or infringing content
Attempt unauthorized access to systems or data
Misuse the App in a manner that disrupts services
5. Intellectual Property
All software, trademarks, designs, and content associated with AccuClaim are the property of Independent Restoration Services Holdings LLC or its licensors.
A limited, non-exclusive, non-transferable license is granted solely to use the App as intended.
6. User Data & Content
Users retain ownership of their data.
By using the App, you grant AccuClaim permission to process data solely to provide services and improve functionality.
Aggregated and De-Identified Data
Notwithstanding anything to the contrary, User retains ownership of all User Data submitted to the App. User grants AccuClaim and Intelligent Restoration the perpetual, irrevocable right to create, maintain, use, and distribute aggregated and de-identified data derived from User Data (“Aggregated Data”), provided that such Aggregated Data does not identify User, User’s organization, or any individual.
Aggregated Data may be used for benchmarking, performance analysis, service improvement, and industry reporting purposes and may survive termination of the User’s account.
7. Disclaimer of Warranties
The App is provided “as is” and “as available.”
We do not guarantee uninterrupted service, accuracy of outputs, or specific claim outcomes.
8. Limitation of Liability
To the maximum extent permitted by law, AccuClaim is not liable for:
Indirect or consequential damages
Loss of profits, revenue, or business opportunities
Insurance disputes or reimbursement outcomes
Data loss beyond reasonable control
9. Termination
We reserve the right to suspend or terminate access for violations of these Terms or misuse of the App.
Users may request account deactivation at any time.
10. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
